A Simple Guide for FY 2025-26 (AY 2026-27)<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Picking the wrong ITR form is one of the most common \u2014 and most avoidable \u2014 tax filing mistakes. File the wrong one, and the Income Tax Department can flag your return as <strong>defective under Section 139(9)<\/strong>, forcing you to refile within 15 days or risk your return being treated as invalid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The good news: for most people, the right form comes down to answering three simple questions. Here&#8217;s how to get it right for FY 2025-26 (AY 2026-27).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What&#8217;s New This Year<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Two changes have made <strong>ITR-1<\/strong> usable by more salaried taxpayers than before:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Two house properties allowed<\/strong> \u2014 Previously, owning a second house (even a small rented-out flat) forced you into ITR-2. Now you can hold up to two properties and still file ITR-1.<\/li>\n\n\n\n<li><strong>Small LTCG allowed<\/strong> \u2014 If your long-term capital gains from listed shares or equity mutual funds (under Section 112A) are up to <strong>\u20b91.25 lakh<\/strong>, and you have no losses to carry forward, you no longer need to move to ITR-2 for that alone.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">If you filed ITR-2 last year purely because of a second property or a small mutual fund gain, you may be able to switch back to the simpler ITR-1 this year.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Three Questions That Decide Your Form<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Question 1: Do you have income from a business or profession \u2014 including F&amp;O trading?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Yes<\/strong> \u2192 You need <strong>ITR-3<\/strong> or <strong>ITR-4<\/strong>. Even if you&#8217;re a full-time salaried employee who dabbles in F&amp;O on the side, that pushes you out of ITR-1\/ITR-2 and into ITR-3.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Question 2: Do you have capital gains beyond the small exception, foreign income\/assets, a directorship, or unlisted shares?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Yes<\/strong> \u2192 You need <strong>ITR-2<\/strong>. <strong>No<\/strong> \u2192 You likely qualify for <strong>ITR-1<\/strong>, subject to the income cap below.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Specifically, move to ITR-2 if any of these apply:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Short-term capital gains, or long-term capital gains above \u20b91.25 lakh<\/li>\n\n\n\n<li>Gains from selling property, gold, debt mutual funds, or unlisted shares<\/li>\n\n\n\n<li>More than two house properties<\/li>\n\n\n\n<li>Foreign income or foreign assets \u2014 including <strong>RSUs or ESOPs from a foreign employer<\/strong>, overseas bank accounts, or foreign mutual funds (Schedule FA disclosure is mandatory even if there&#8217;s no taxable income from these assets)<\/li>\n\n\n\n<li>You&#8217;re a director in any company (listed or unlisted)<\/li>\n\n\n\n<li>You hold unlisted equity shares at any point during the year<\/li>\n\n\n\n<li>You&#8217;re an NRI or RNOR (ITR-1 is only for resident individuals)<\/li>\n\n\n\n<li>Agricultural income above \u20b95,000<\/li>\n\n\n\n<li>Total income above \u20b950 lakh, with no business income<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Question 3: Are you eligible for presumptive taxation?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If you have business or professional income, you have one more
